The role of intellectual property in developing start-up innovation

Intellectual property plays an increasingly important role for socio-economic development, is a tool in the process of international integration, and creates a driving force for innovative research activities. The intellectual property legal system is considered one of the fastest growing legal systems in Vietnam. The Law on Intellectual Property was promulgated in 2005, revised in 2009, 2019 and on June 16, 2022, the National Assembly voted to pass the Law amending and supplementing a number of articles of the Intellectual Property Law. The purpose of this amendment is to promote creative organizations and individuals, invest in research and development, promote technology transfer, and commercialize intellectual property rights objects to attract more investment capital to create more favorable conditions for organizations and individuals in business activities.

The World Intellectual Property Organization has announced the message of World Intellectual Property Day (April 26) 2022 as "Intellectual property and the young generation to innovate for a better future". The purpose is to encourage the young generation, the pillar generation of the country, to always seek creativity and create better creations for the future, to help the country become more prosperous and develop.

Realizing the role and importance of intellectual property in the development of innovative start-ups, start-up groups need to equip themselves with basic knowledge of intellectual property to serve their careers. Start-up development:

- It is necessary to raise awareness of intellectual property rights, invest time, money and creative thinking in intellectual property to soon implement the establishment of rights;

- Find out by yourself available search sites such as: https://ipvietnam.gov.vn/; https://wipopublish.ipvietnam.gov.vn; http://www.cov.gov.vn;http://pvpo.mard.gov.vn;… to ensure that their rights and interests do not infringe upon the intellectual property rights of others;

- Quickly establish intellectual property rights when you have an idea or plan to establish a company;

- At the same time, always update and add new legal knowledge related to intellectual property...

In recent years, our Party and State are very interested in developing and perfecting the Law on Enterprises in general as well as the Law on Intellectual Property in particular. Currently, the Law on Intellectual Property has been widely disseminated among the majority of businesses, universities, institutes, researchers and in the mass media to raise public awareness. on intellectual property and innovation is extremely important.

In addition, in order to promote the registration of intellectual property protection at home and abroad, according to Article 6 of Circular 75/2021/TT-BTC dated September 9, 2021 issued by the Ministry of Finance on financial management. main implementation of the Intellectual Property Development Program to 2030, supporting 30 million VND/application for patent protection applications and registration for protection and recognition of new plant varieties; 15 million VND/protection title for industrial design and trademark protection registration applications; 60 million VND/application is validly accepted for protection registration in foreign countries.

Today, start-up groups only focus on how soon to set up a company to go into production and business operations. Next, we proceed to seek investment capital to perform well for the business. Start-up groups do not think that the first thing to do is to study the Intellectual Property Law, Circulars and Decrees with the aim of raising awareness, exploitation capacity, management and protection of intellectual property rights in order to improve the awareness and capacity of exploiting, managing and protecting intellectual property rights. contribute to socio-economic development. At the same time, it is necessary to register for intellectual property protection related to products and services that the company will implement in the near future. The fact also shows that innovation is inseparable from intellectual property, so intellectual property is becoming more and more important for start-up groups. Startup groups also do not know how to effectively utilize and exploit information about intellectual property. Therefore, there are many start-up groups that have spent a lot of time and money when they have to focus on researching inventions, industrial designs, etc., which have been granted protection titles by the National Office of Intellectual Property. The good exploitation of available information is also a guideline and also an important key for startup teams when embarking on research.             

In summary, a start-up group that understands the Intellectual Property Law will have advantages over other startup groups that have not yet, specifically as follows:

When start-up groups have enough knowledge about intellectual property, conducting research and innovation will meet many favorable conditions in business development, creating more jobs to help the country rapidly develop.
